GUELPH, ON, June 29 - - Old Roxy Entertainment Inc., a former theatre
in Mount Forest, Ont., was fined $10,000 on June 25, 2007 for a violation of
the Employment Standards Act in connection with wages owed to a former
employee.
Old Roxy Entertainment Inc. owed a total of about $4,675 to a former
employee who filed a claim with the Ontario Ministry of Labour for unpaid
wages. The ministry found that wages were owing and issued the employer an
order to pay for $4,675 for unpaid wages, including vacation pay, plus a
10-per-cent administrative fee. The order was issued on February 16, 2005. The
employer failed to pay the order and did not appeal it to the Ontario Labour
Relations Board. The workplace was at 111 Queen Street West in Mount Forest,
located about 74 kilometres (46 miles) north of Kitchener, Ont.
Following a trial, Old Roxy Entertainment Inc. was found guilty of
failing to comply with an order to pay, as required by Section 103(8) of the
act. This was contrary to Section 132 of the act.
The fine was imposed by Justice of the Peace James Ziegler of Ontario
Court of Justice in Guelph. In addition, the court imposed a 25-per-cent
victim fine surcharge, as required by the Provincial Offences Act. The
surcharge is credited to a special provincial government fund to assist
victims of crime. In addition, the court issued an order to the company
requiring $4,675 in owed wages be paid to the former employee.
